A sign on the door of both establishments say it has been 'seized'

The New York State Department of Tax and Finance has seized two restaurants on Phila Street in downtown Saratoga. The District, at 43 Phila and Nashville of Saratoga at 39 Phila have notices posted on the door that both pieces of property are now in possession of New York State.

Both restaurants have the same owner. Tax and finance officials tell News 10 that The District owes $25,505 in back taxes, while Nashville owes over $83,000.

Seizure is typically a last resort after substantial periods of non-compliance and/or non-responsiveness. It’s not something we like doing but not to enforce the law in this regard is unfair to others in the same business. People who abide by tax laws should not be at a competitive disadvantage

The tax and finance department says both establishments will be allowed to reopen as they make a good faith effort to comply with the law.

News 10 reached out to the owners, but have not heard back.
